This document serves as a binding contract between the customer hereafter known as “Host,” and 1Up Events, hereafter known as “Planner.” By checking this box, Host has read and agreed to the following terms. Both parties agree to abide by the following conditions:
Setup & Takedown: Setup will be approximately 2 hrs before event start time. Takedown will be completed approximately 2 hrs after event conclusion.
Payment: The Planner will collect payment information upon confirmation of the event. The Host will be charged in full for the event upon completion of the event.
Headcount: The cost of the event remains the same regardless of decreased headcount or turnout after the event is booked. If the expected number of people in attendance exceeds the original estimate by more than 10 people after booking, additional charges may apply.
For events costing less than $5,000, a 25% cancellation fee will be charged, if the Host cancels the event more than 2 weeks before event date.
For events costing $5,000 or more, a 50% cancellation fee will be charged, if the Host cancels the event more than 2 weeks before event date.
If the Host cancels the event less than 2 weeks before event date, no refund will be given and full amount of the event is due.
In the event of extenuating circumstances, the Planner may issue a partial refund at the Planner's discretion.
Rescheduling: If Host needs to reschedule, the Host is responsible for paying all additional nonrefundable fees that the Planner incurs as a result of rescheduling (in addition to the original total cost of the event). The more advance notice the Host is able to give the Planner, the more flexible the Planner can be and the smaller the nonrefundable fees are more likely to be. In the event of extenuating circumstances, the Planner may waive some of these fees at the Planner's discretion.
Host acknowledges liability for any damage caused to Venue (either Host's office or other outside venue), 1Up Events' property, or vendor's property, by any guests or employees of the Host during the course of the events.
Host will indemnify and hold Planner harmless and in no way accountable for any liability for personal injury to guests or employees of the Host during the course of the event.
Host is responsible for ensuring compliance to any building requirements for an in-office event (e.g. does the building allow animals?).
For Venue Finding Service:
Venue finding fee is non-refundable.
The fee will be charged after the 3 options are presented to the Host.
Planner will provide Host with 3 options that meet all specifications based solely on the information provided by the Host at time of checkout.
At the time the options are presented, all venue options provided by Planner will be available at the date requested. If the Host chooses to book the venue at a later date or on a date that was not originally requested, venue availability is not guaranteed.
LIMITATION OF LIABILITY: The Planner will not be liable for any indirect, special, consequential, or punitive damages (including lost profits) arising out of or relating to this agreement or the transactions it contemplates (whether for breach of contract, tort, negligence, or other form of action) and irrespective of whether the Planner has been advised of the possibility of any such damage. In no event will the Planner’s liability exceed the price the Host paid to the Planner for the specific event provided by the Planner giving rise to the claim or cause of action.
DISCLAIMER OF WARRANTY; DUE DILIGENCE. The event is being sold “as is,” and the Planner disclaims all warranties of quality, whether express or implied, including the warranties of merchantability and fitness for particular purpose.
Force Majeure: Nonperformance by either Party will be excused to the extent that performance is rendered impossible by strike, fire, flood, governmental acts or orders or restrictions, failure of suppliers, or any other reason where failure to perform is beyond the control and not caused by the negligence of the non-performing Party. Inclement weather and traffic shall not render performance impossible.
The Planner is allowed to use the Host’s logo in publicizing the event, and on the Planner’s website to showcase clients and past events.
The Planner is allowed to use any and all pictures taken at the event (including those with the host’s logo) for their website and future marketing. It is at the Host's discretion to request removal of any pictures.
